ALL NEW LEASES MUST INCLUDE:
1. Cleanliness standard
The tenant must keep the balcony, railings, and balcony drain clear and reasonably clean at all times. “Reasonably clean” means free of garbage, food waste, overflowing containers, loose soil, debris, and any buildup that causes odour, pests, staining, or blocked drainage. This aligns with the tenant's duty to maintain reasonable health, cleanliness, and sanitary standards in areas they have access to.
2. No obstruction / storage
The balcony drain, edges, and walking surface must remain unobstructed. Storage of excess items, cartons, or refuse is not permitted on the balcony.
3. Item security and safety
Furniture and planters must be stable and secured so they cannot be blown or knocked off the balcony. No items may hang over or be draped on the glass railing.
4. Cleaning after notice
If written notice identifies cleaning or removal work, the tenant must complete it within the cure period stated in the notice.
5. Enforcement
This is a material term of the tenancy. If the tenant breaches this term and does not correct it within a reasonable time after written notice, the landlord may issue a One-Month Notice to End Tenancy for cause for breach of a material term not corrected after notice, subject to the Residential Tenancy Act.
6. No change to statutory rights
Nothing in this addendum changes or contradicts the Residential Tenancy Act or the Standard Terms. Any change must be agreed to in writing and initialed by both landlord and tenant. Unconscionable or contradictory terms are not enforceable.
